Mary Morris sued the State after her incarcerated husband attacked her during a prison visit. Following a four-day bench trial held May 19–22, 2014, the district court awarded Morris $174,000.
The State appealed, challenging liability on discretionary-function-immunity, public-duty-doctrine, and foreseeability grounds. On October 14, 2015, the Iowa Court of Appeals rejected the State's challenges and affirmed the judgment. Van M. Plumb and Rouse represented Morris at the bench trial and on appeal.
